GENERAL CONDITIONS OF SALE

1.Orders

Acceptance of the present general conditions

All orders made to Edouard Artzner using the order form on the website imply the full and complete acceptance of these conditions of sale, which themselves are solely applicable to the contract thus agreed.

Availability

All orders will be fulfilled depending on the level of available stocks and according to the defined delivery timescales. All fresh products are made on order to guarantee their quality/freshness and to best meet our customers’ expectations.

NB: Our fresh products cannot be delivered outside mainland France.

Our special offers are subject to availability. In the event of a product being unavailable after you have made your order, we will inform you by email or by telephone within 72 hours. You could then cancel your order or make a different request.

Ordering procedures

The order is only processed once the order form on the website has been duly completed by the customer. This is only taken to be effective once the banking centers concerned and Edouard Artzner have given their approval. Edouard Artzner will confirm acceptance of the order to the customer by email. In the event of refusal by the above-mentioned centers, Edouard Artzner reserves the right to cancel the order and to inform the customer within 48 working hours after the order has been entered by Internet.

Our customers’ details

To handle your orders, we would ask you to specify your full name, address (specify the door entry code where necessary), telephone number, mail address, order date, and if you already have one, your customer reference in order to assist us. We are not able to process incomplete orders.

In accordance with the IT Freedom Law, we inform you that entering your details in the compulsory "Identification" and "Contact" sections is essential for your order to be dealt with.

The data collected will only be used by Edouard Artzner. It will enable us to process your order, offer you personalized service and provide you with information about our products and services. It is also used for the purpose of loyalty, management and statistical analysis.

In accordance with article 34 of Law N° 78-17 of January 6 1978 relating to IT, files and freedom, Edouard Artzner reminds you that you have a right of access, rectification or removal of data relating to you.

In accordance with the IT Freedom Law, we undertake that we will not divulge your personal data which is processed and stored in a manner which ensures its security. You also have the right to access, rectify or remove personal data.

Reimbursement and replacement

Edouard Artzner takes the greatest care in preparing its orders. Nonetheless, it is incumbent on the recipient to check the quantity and condition of products on receipt.

In the event of a delivery problem, a written claim must be submitted to Edouard Artzner within 24 hours following delivery.

Our customers agree to strictly adhere to the storage specifications for products as well as the expiry dates specified on the packaging.

The customer may not submit a claim based on the product’s taste, freshness or appearance.

If a product is out of stock, we will substitute it with a similar product or one of a higher value so that the delivery is not delayed (unless otherwise indicated by the customer).

Right of retraction: within 14 days

The customer has the right, within 14 working days following the date of receiving the package, to exercise his/her right of retraction without having to justify it or pay any penalties.

In accordance with article L.121-20-2 of the Consumer Law, the right of retraction cannot be exercised by the customer for any products likely to deteriorate or rapidly expire (i.e. all fresh and semi-cooked products). No return or replacement of a specialty product can be accepted if the expiry date has been exceeded.

In the event of exercising the right of retraction (only possible for preserved products), the customer must return the product unopened in its original packaging in a new extension of time of 14 days.

The cost of the product as well as the postage costs will be refunded in this new extension time.

"Applicable law and jurisdiction

These General Conditions of Sale, and the contractual relations associated therewith, are governed by French law. The language of this contract is French.

Any dispute shall be brought before the competent courts in accordance with the rules of common law (or of private law) ″.

2.Obligations

Edouard Artzner’s obligations

Edouard Artzner undertakes, once an order is approved, to supply and deliver by post the products that the customer has ordered within 5 working days following receipt of the order.

Customer obligations

The customer commits to properly filling in the order form.

The customer may not re-sell the products, as his/her order is solely destined for his/her personal use or for the use of the person to whom the delivery is addressed.




3. Specific conditions

Terms and conditions of payment

The cost of products and delivery are invoiced inclusive of tax. Prices are fixed within the limits of available stock and the VAT rate is subject to modification without notice. Any change in the rate of taxation will immediately be reflected in the selling price. The total price shown in the order confirmation from Edouard Artzner is the definitive price. The price is given in Euros.

Products are to be paid for effective as of the order date. Payment is made on line by means of a secure payment system only using VISA or MASTERCARD bank cards. The customer’s bank card will be debited once the order is accepted.

N.B: A detailed invoice will be attached to the package. The indication of the amount of VAT paid may allow associations, companies and the self-employed to reclaim it.




Delivery location and timescale

ll of the products shown on the website are for sale in mainland France (no fresh or semi-cooked products will be delivered to Corsica or overseas departments and territories) as well as in the countries shown on the site depending on the type of product (e.g. some fresh products cannot be exported because of their required storage conditions).

The delivery cannot be made unless full payment is received.

Delivery in the countries concerned takes place by posted package within roughly 5 days of order confirmation.

“Any delay or failure to perform the services provided for within the framework of this agreement shall not consitute a fault attributable to Edouard Artzner where it can be shown that such a delay or faliure to perform is attributable either to the consumer, or to the unforeseeable and unavoidable actions of a third party to the contract, or to a case of force majeure as defined by the regulations in accordance with Article L. 121-20-3 of the French Consumer Code”.

Delivery is made to the address indicated by the customer on the order form. The customer undertakes to take receipt of the products ordered on the agreed date.

If the recipient is absent when the delivery is made, Edouard Artzner cannot, in any circumstance, be held responsible for any deterioration which may occur to the products, or for the recipient not receiving the product.



4. Table of delivery cost zones

Country: France

  • In Chronofresh: Fresh products will be shipped exclusively through Chronopost. The shipping and packing costs Chronopost amount to 12,90 €.

  • In Colissimo: Participation in the costs of Shipping and Packing Standards amount to  8.90 €

  • When the order contains fresh products and preserved products, it will be shipped exclusively through Chronofresh.

For sending abroad:

In Chronopost International  : The cost varies according to the weight of your package and the country of destination.

You can always know the amount of processing fees and shipping in your shopping cart.

Zone 2

Countries: Great Britain, Ireland, Italy, Spain, Portugal., Austria.
